(A) any weapon . . . which will or is designed to or may readily be converted to expel a projectile by the action of an explosive;
The Second Amendment didn't get raised here; this is really all about the Administrative Procedures Act and whether the ATF had the authority to issue new rules classifying firearms kits as actual firearms.
