Alito dissent on the Supreme Court stay in NetChoice LLC v Paxton
www.supremecourt.gov/opinions/21pdf/21a720_6536.pdf
A couple issues:
- The request for a stay (which was granted) mentions only the first
amendment, not §230.
- The law only authorizes the Texas Attorney General to bring a legal
action requesting compliance, so no one is harmed until such action
takes place.
- There are precedents where, say, shopping centers and malls
have had to allow speakers to appear on their property.
That said, Alito chooses to ignore the fact that HB 20 seems, on its
face, to flatly contradict §230.
