Jason Fyk sued Facebook:
Plaintiff had used Facebook’s free online platform to create a series of, among other amusing things, pages dedicated to videos and pictures of people urinating. In enforcing its community standards,Plaintiff alleges that Facebook blocked content posted by Plaintiff and removed content in order tomake room for its own sponsored advertisements.
The District Court decision to dismiss Fyk's case was only 3 pages long. It's not rocket science. The Ninth Circuit just affirmed.
Sen Josh Hawley (R, MO) has proposed major changes to §230. I don't think Hawley has any idea of what his bill might lead to, because if Fyk doesn't declare his approach to be a political party, someone else will.
‘‘(ii) POLITICALLY BIASED MODERATION — The moderation practices of a provider of an interactive computer service are politically biased if — ‘‘(I) the provider moderates information provided by other information content providers in a manner that — ‘‘(aa) is designed to negatively affect a political party, political candidate, or political view point; or ‘‘(bb) disproportionately restricts or promotes access to, or the availability of, information from a political party, political candidate, or political viewpoint; ‘(II) an officer or employee of the provider makes a decision about moderating information provided by other information content providers that is motivated by an intent to negatively affect a political party, political candidate, or political viewpoint.
I have no idea what gives with Jason. He spent a lot on this litigation. Is he a §230 provocateur? Is he making fun of §230? In the past he made a lot of money on Facebook, so that seems unlikely.
Consumer data could only be used in ways spelled out in the law.
