European Copyright Updates

The EU is preparing to update their copyright law. Two controversial proposals are Articles 13 and 11.

Article 13 would withdraw the DMCA-like copyright safe harbor for user-posted content. Supposedly this is to be done without requiring a "general monitoring obligation", but nobody has any idea how that would work. Because of the volume, monitoring systems would have to be automated, which strips away Fair Use rights. There's an exception for Wikipedia, but not for Github.

Article 11 eliminates the Fair Use right of search engines to include "snippets" of news articles in their search results. Search engines would need a license for even the most minimal use. Never mind that such snippets are what drive users to click on the links.

Much of this relates to anti-Google sentiment in Europe.
