The
European Court of Human Rights may have effectively just banned
user-contributed content
The ECHR found that a news site in Estonia might be liable for defamatory
article comments posted by users. The court found that the comments were
"hate speech" and that the site had no provision for monitoring or taking
down such comments. Of course, the whole point of §230 in the US is that
such monitoring is essentially impossible.
The ECHR found that the comments met the standard of "manifestly unlawful".
However, that remains a very vague standard; if the decision stands, it will
likely result in the closure of many user-comments sites.
In 2012 the Court of Justice of the European Union (CJEU) found that
websites could not be forced to monitor content.
We'll see what happens.
